1. Introduction and Acceptance

Welcome to KH855.com (the "Platform" or "We"). These Terms and Conditions ("Terms") govern your access to and use of the KH855 website, including any content, functionality, and services offered on or through KH855.com. By clicking "I agree," registering an account, or otherwise using the Platform, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

2. Platform Role

KH855.com acts as an online marketplace connecting businesses and individuals ("Employers") who seek services with independent contractors ("Freelancers") who offer services ("Services"). We are not an employer of any Freelancer. We are a neutral venue and are not a party to the contractual agreements between Employers and Freelancers. KH855 is solely responsible for facilitating the availability of the Platform.

3. Eligibility and Account Registration

Age Restriction: Use of the Platform is limited to users who are 18 years of age or older.
Account Security: You are responsible for safeguarding the password and credentials used to access the Platform. You agree not to disclose your password to any third party.
Accurate Information: You must provide accurate and complete information when registering an account and keep your profile information up-to-date.

4. User Obligations and Conduct

For All Users

You agree not to use the Platform to:

Post or transmit content that is illegal, defamatory, harassing, or violates any third-party rights.
Interfere with the security or proper functioning of the Platform.
Attempt to bypass or circumvent our fee structure or payment systems.

For Employers

Job Posts: You are responsible for providing clear, accurate, and complete descriptions for any job post or service request.
Review: You agree to promptly review the work submitted by the Freelancer and authorize payment (release from Escrow) upon satisfactory completion.

For Freelancers

Service Quality: You warrant that all Services provided are of high professional quality and meet the terms agreed upon with the Employer.
Independent Contractor: You acknowledge that you are an independent contractor and not an employee of KH855.com or any Employer. You are solely responsible for all taxes, insurance, and other liabilities associated with your business.

5. Payments, Fees, and Escrow

Fees: KH855 charges a service fee to Freelancers and/or Employers for use of the Platform, as detailed in our separate Fee Policy (available [Insert Link to Fee Policy]).
Escrow: Employers agree to place funds into an Escrow account managed by KH855 upon contract initiation. Funds are held in Escrow until the work is completed and approved by the Employer.
No Circumvention: Users agree to make and receive all payments for Services originated through the Platform exclusively through KH855.com for the duration of the project and for a period of [Insert Time, e.g., 24 months] thereafter.

6. Intellectual Property and Ownership

Freelancer Deliverables: Upon full payment for the Services, the Freelancer agrees to assign all right, title, and interest in and to the work product ("Deliverables") to the Employer.
Platform Content: All content, graphics, logos, and features of the KH855.com Platform are owned by KH855 and are protected by intellectual property laws.

7. Dispute Resolution and Refunds

Dispute Process: If an Employer and Freelancer cannot resolve a payment or work dispute, both parties agree to participate in KH855's mandatory Dispute Resolution Process.
KH855 Decision: We will review all evidence submitted by both parties and may, at our sole discretion, mediate, or decide how the funds held in Escrow should be distributed. This decision is final and binding on both parties.
No Guarantee: KH855 does not guarantee the quality of the Services or the truthfulness of profiles. We provide the marketplace, but all contracts are strictly between the Employer and the Freelancer.

8. Limitation of Liability

To the fullest extent permitted by applicable law, KH855.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the Platform or the inability to use the Platform.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of [Insert Jurisdiction, e.g., The Kingdom of Cambodia], without regard to its conflict of law provisions.

10. Changes to the Terms

We reserve the right to revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.
